Biography

He advises and assists French and international companies of all sizes, as well as their executives, in managing both pre-litigation and litigation matters. Within the firm, Guilhem leads a multidisciplinary team of specialist litigators, or coordinates external experts dedicated to a specific dispute, enabling him to design and personally drive procedural strategy and appear before civil, commercial, criminal and employment courts.

He advises clients across a wide range of sectors, including real estate, construction, transport, telecoms, industry, serviced residences and property management, professional services, start-ups (biotech and medtech), luxury, food service, hospitality, retail and franchising.

Guilhem is regularly instructed in complex disputes, particularly those involving commercial leases, unfair competition, disruption of commercial networks, abrupt termination of established commercial relationships and shareholder conflicts.

He also acts in arbitration proceedings, including matters conducted under the rules of the International Court of Arbitration of the International Chamber of Commerce (ICC).

He is a member of the “Law and Procedure” association of the Paris Bar.

  • Advising an investment fund on a dispute arising from the exclusion of a minority shareholder and the resulting capital restructuring, including the restitution of shares.
  • Advising a leading group on a dispute concerning an objection to a transmission universelle de patrimoine (universal transfer of assets) and an action seeking the annulment of an extraordinary general meeting.
  • Advising a French holding company on a dispute relating to the non-performance of a share purchase undertaking, arising from disagreements between shareholders and forming part of broader connected criminal proceedings with a transnational dimension (France, Portugal and the USA).
  • Advising and representing a French industrial company on a contractual and banking dispute before the French courts, before the Indian courts, and in ICC arbitration proceedings in Singapore against an Indian industrial group, seeking compensation for losses arising from the unlawful termination of two supply contracts for production lines and the blocking of related first-demand bank guarantees.
  • Advising a leading operator of serviced residences on serial, large-scale disputes initiated by investors following real estate acquisition transactions.
  • Advising a leading operator of serviced residences on complex disputes concerning the transfer, following judicial safeguard proceedings, of managed serviced-residence assets.
  • Advising and representing a group of companies and its director further to a private criminal prosecution (citation directe) for defamation, insult and assault.
