Biography

Emmanuel has significant experience in cross-border work. He operates regularly in the United States, Spain, Italy and Japan. He previously headed the Vietnam and Mexico offices of his former firm and remains closely involved in these jurisdictions. He assists entrepreneurs and corporate groups at every stage of their international development, with a strong command of cultural nuances and complex legal environments.

He also advises international family offices and private clients (HNWIs) on the management, structuring and transmission of their assets, as well as on maintaining family balance, including in contentious situations. In this context, he has developed particular expertise acting for international professional athletes, agents, artists, designers and figures from the entertainment industry.

Emmanuel acts in the resolution of domestic and international disputes. He advises on strategy and represents clients before French and foreign courts. He is regularly instructed in high-stakes, complex disputes involving multiple parties, jurisdictions or international interests.

His arbitration practice covers both commercial and investment arbitration. He has acted in proceedings conducted under the rules of the International Chamber of Commerce (ICC), the Court of Arbitration for Sport (CAS) and the International Centre for Settlement of Investment Disputes (ICSID).

While he works across a broad range of industries, he has notable experience in structuring transactions and managing strategic disputes for leading French and international players in the food service, furniture and luxury sectors, as well as real estate development and construction, involving governance, shareholding and contractual performance issues.

Emmanuel plays a central role in the firm’s strategy on ecological transition and sustainable development. He was one of the driving forces behind MMlaw’s decision to join the United Nations Global Compact in 2012 and continues to advance this commitment through his professional engagements.

He is also Honorary Chairman of the Alliance of Business Lawyers (ABL), an organisation he chaired from 2010 to 2020, bringing together more than 50 law firms worldwide.

Emmanuel founded Miguérès Moulin in 2010.

  • Advising the TALEK group on the sale of its 50% stake in its Washington DC industrial site (Bakery de France), dedicated to the production and distribution of bakery products for the US market, to a major Europe-based industrial manufacturer.
  • Advising an airport-services operator in connection with a strategic capital increase enabling the entry of several investment funds affiliated with a major French banking group, to support its international expansion and energy-transition initiatives.


Litigation – Arbitration

  • Advising and representing a holding company owning a major food-retail brand operating hypermarkets and supermarkets in the Paris region in a dispute relating to the acquisition of a competing group by a third party, primarily based on an estimate relating to the construction of a shopping centre.
  • Advising a leading Belgian group specialising in engineering and active in the space, defence, cybersecurity and critical-infrastructure sectors on a dispute brought by the opposing party seeking the enforced performance of a promise to sell a real estate complex.
  • Advising and representing a company active in the food-retail sector in a dispute relating to damage occurring during the construction of a shopping centre.
  • Advising and representing a British industrial group, a major player in corrugated-cardboard packaging, in a dispute arising from an accident at one of its factories which resulted in the death of an employee of a German subcontractor.
  • Advising a leading Belgian group specialising in engineering and active in the space, defence, cybersecurity and critical-infrastructure sectors on a dispute brought by the opposing party seeking the enforced performance of a promise concerning a real estate asset.
  • Advising and representing a leading French industrial group in the bedding sector in a dispute relating to the termination of established commercial relations.
  • Advising and representing a real estate asset management group in a dispute concerning commercial leases with an investor group active in the serviced-residence sector.
  • Advising and representing a Paris-based group in a dispute with a French company specialising in the distribution of branded products in the fashion sector.
  • Advising and representing a French premium bakery operator in a commercial dispute with two companies based in Panama and Colombia.
  • Advising and representing a real estate group in a dispute concerning the operation of a major national shopping centre.
  • Advising on a shareholder dispute concerning the governance and allocation of share capital in companies operating a leading shopping centre in France.
  • Advising on a shareholder dispute linked to succession matters and the reorganisation of the shareholding structure of an emblematic company in the fashion sector.
  • Advising on a shareholder dispute concerning the allocation of share capital in a well-known press group, publisher of several specialist titles.
  • Advising on a shareholder dispute concerning the shareholding structure of the companies that designed and operate a shopping centre in France.
  • Representing a French investor, Mr Bachar Kiwan, in an ICSID investment arbitration against Kuwait (Case No. ARB/20/53), initiated in December 2020. The dispute concerns the protection of Mr Kiwan’s investments in the audiovisual sector in Kuwait. He seeks compensation for losses arising from Kuwait’s breaches of foreign-investment protection standards, including fair and equitable treatment, full protection and security, and protection against unlawful expropriation.
  • Representing a leading French industrial group in the agri-food sector in an ICC commercial arbitration concerning a dispute relating to the termination of established commercial relations and issues involving brand licences in Chile and Colombia.
